Codes change. This is a plain-language summary for planning, based on the published codes. Confirm with the planning office for your parcel and read your HOA documents before you build. We check both before every quote.

Step One: Find Out Who Governs Your Parcel

A "Gainesville, GA" mailing address covers a large area, and a big share of it is unincorporated Hall County, not the City of Gainesville. Oakwood, Flowery Branch, Lula, Clermont and the other cities have their own codes as well. Your property tax bill or the Hall County parcel map shows which jurisdiction you are in.

City of Gainesville

  • Height: fences and freestanding walls can be up to 8 feet in a yard.
  • Residential front yards: limited to 42 inches (3½ feet) between the house's build-to line and the front lot line.
  • Front-yard materials: brick, stone, wood, stucco, wrought iron, split rail or vinyl. Chain link is only allowed there if it is black vinyl-coated.
  • Finished side: fences must present a finished, attractive face to the outside, and be consistent in style and material along their length.
  • Banned materials: exposed concrete block, tires, junk and other discarded materials.
  • Sight lines: no fence can block visibility at street intersections.
  • Driveway gates: vehicle gates cannot be closer than 25 feet to a public street right-of-way.

Unincorporated Hall County

  • Side and rear yards: up to 7 feet.
  • Yards next to a street: up to 6 feet. Corner lots have two of these.
  • Walls: freestanding walls are limited to 4 feet. Retaining walls over 4 feet need a permit with plan review.
  • Permits: fences built within the height and material standards do not require a building permit.
  • Residential materials: wood, brick, stone, decorative metal and similar. Scrap materials are prohibited.
  • Barbed wire: in residential districts, only for permitted agricultural use.
  • Nonresidential property: fences must be ornamental or decorative, with restrictions on chain link, barbed wire and metal mesh.

Flowery Branch

  • Residential front yards: 4 feet maximum, finished side facing the street.
  • Everywhere else: up to 8 feet.
  • Front-yard chain link: must be black vinyl-coated.
  • Barbed wire: only where livestock is lawfully housed on the lot.

Other Cities and Counties

Oakwood, Buford, Braselton, Hoschton, Jefferson, Lula, Clermont, Dahlonega, Cleveland and Cumming, plus Jackson, Gwinnett, Forsyth, Lumpkin, White and Banks counties, each have their own rules. Many follow a similar pattern of a low front-yard limit and taller fences allowed behind the house, but the numbers differ. We look them up for your address.

HOAs Usually Have the Last Word

If your neighborhood has an HOA, its covenants can be stricter than any city or county rule, and they are enforceable. Common HOA rules: 6 foot maximum height, approved styles and colors only, finished side out, fence starting behind the front corner of the house, and no chain link. Submit for approval before you sign a contract with an install date.

Pool Fences

Pool barriers have their own requirements and are usually inspected with the pool permit: at least 48 inches tall, no openings that pass a 4 inch sphere, a limited gap at the bottom, and self-closing, self-latching gates. See pool fences.

Lake Lanier

Most of the shoreline is U.S. Army Corps of Engineers property, and private fences are not allowed on it. A lake lot fence has to stop at your property line, which is often well back from the water.

Call 811 Before Anyone Digs

Georgia 811 marks buried public utility lines for free. Their guidance is to submit a locate ticket at least three business days before digging. It does not mark private lines like irrigation or pet fence wire.

Frequently Asked Questions

Do I need a permit for a fence in Hall County?

In unincorporated Hall County, fences that meet the height and material standards do not require a building permit. Cities inside the county have their own rules, and HOA approval is separate.

How tall can a front yard fence be in Gainesville?

In the City of Gainesville, residential front-yard fences are limited to 42 inches. In Flowery Branch it is 4 feet. In unincorporated Hall County, a fence in a yard next to a street can be up to 6 feet.

Can my neighbor make me pay for half the fence?

Georgia has no general law requiring neighbors to split the cost of a boundary fence. It comes down to agreement, and it is wise to put any agreement in writing.

Which side of the fence has to face out?

The City of Gainesville requires a finished face toward the outside, Flowery Branch requires it toward the street in front yards, and many HOAs require it everywhere. Board-on-board fences look finished on both sides.
